Long Term Visa / Long Term Stay in Malaysia

Many has aware of the appealing advantages of Labuan company in terms of the unique taxation system, ownership policies, incorporation procedures and many others.

Few might know that a director of a Labuan Company can obtain a long term stay or long-term visa in Malaysia by applying for a Labuan Work Permit or Labuan Director Visa. Upon approval of the Labuan work permit or Labuan Director Visa. the visa shall grant you the unlimited entry permit to Labuan and West Malaysia (which include cities like Kuala Lumpur, Johor Bahru, Ipoh and Penang) for the duration of two (2) years. The applicant shall be paid a salary of MYR10,000 per month or its equivalent in any currency by the Labuan Company. The income may include the following:
1. Basic salary
2. Cash allowances (e.g. perquisites, meal, transportation, housing etc)
3. Benefits-in-kind
4. Value of living accommodation or
5. fees and commissions.

It is very important to note that the application for Labuan Work Permit should be in respect of the following positions in a Labuan company as specified by the Immigration Department of Malaysia.
1. Top management such as Member of the Board, Executive Director, Managing Director, Principal Officer, Chief Executive Officer (CEO), Chief Financial Officer (CFO), Chief Operating Officer (COO) etc of the company.
2. Professionals such as Accountant, Lawyer, Consultant, Underwriter, Economist, Advisor, Engineer, Actuary or Trader (for those who employed under Labuan International Commodity Trading Company) of the company.
3. Technical experts such as Information Technology (IT) or other specialists related to the business activities of the Labuan company.

The applicant of the Labuan Work Permit should also prepare a comprehensive business plan which includes
– Description of business undertaken.
– A clearly defined organization chart and
– A detail job description of the applicant.

The business plan shall be submitted to the Labuan Financial Service Authority (Labuan FSA) to fulfill the Labuan Work Permit application requirement. The business plan is one of the key documents for the authority to evaluate and approve the Labuan Work Permit application.
